Terms of Service

Terms of Service

These terms cover the calebdorris.com website, the quote form, text messages, and the basic rules for working with me. A signed written scope covers the details of each project.

Effective October 23, 2026.

Acceptance

By using calebdorris.com, sending the quote form, or opting in to text messages, you agree to these terms and to the Privacy Policy. If you don't agree, please don't use the site.

Who I am

calebdorris.com is run by Caleb Dorris, a sole proprietor in Madison, TN, United States. In these terms, "I," "me" and "my" mean Caleb Dorris, and "you" means the visitor or the client.

Services

I provide web development and online marketing services. That includes custom web applications and portals, PHP and WordPress development, Next.js apps, CRM and API integrations, AI features inside business workflows, replacing legacy software, websites, search and local marketing work, and ongoing support and maintenance. The pages on this site describe that work in general terms. The exact work for a project is whatever its written scope says.

Quotes and written scope

Sending the form, an intro call, and any quote or estimate are free and don't obligate either of us. A quote or estimate is not binding until we both sign a written scope of work. The signed scope sets the deliverables, the phases, the price and the payment schedule. If a signed scope conflicts with these terms, the signed scope controls for that project. Changes to the work are added to the scope in writing.

Your responsibilities as a client

  • Give accurate information, timely answers and the feedback each phase needs.
  • Provide the access, accounts and content the project needs, and make sure you have the right to share them with me.
  • Share passwords and credentials only through the secure method we agree on, never through the website form.
  • Keep your own accounts with third-party services, such as hosting, domains, your CRM and other software, in good standing, and pay their fees.
  • Review and approve each phase, and keep your own backups of your data.
  • Make sure your use of what I build follows the laws that apply to your business.

Payment

Payment terms are set in the signed scope. Scoped projects are usually priced per phase and paid at each milestone. Ongoing work is billed hourly or on a monthly retainer, as the scope says.

Ownership of code and work product

When you have paid in full for a project or phase, you own the custom code, designs and documentation I made for you in that project or phase. Until then, I keep ownership, and you can use the work in progress to review it.

Some things are not custom-made for one client: tools, libraries and techniques I already had or build for general use, and third-party and open-source components. I keep ownership of my pre-existing tools and give you a permanent, non-exclusive license to use them as part of your project. Third-party and open-source components stay under their own licenses. I won't name you as a client or show your project publicly without your permission.

I keep your non-public business information confidential and use it only for your project.

Using this website

The site's text, design and name belong to me. Don't copy them for another site, send false or abusive requests, try to break into or disrupt the site, or use it to break the law. The articles and pages on this site are general information, not professional, legal or financial advice for your situation.

Text messages

The text program is called Caleb Dorris project updates. If you opt in, I text you about your quote request, project status and scheduling. Message frequency varies. Message and data rates may apply.

Reply STOP to opt out at any time. You'll get one confirmation text, and no more texts after that unless you opt in again. Reply HELP for help, or email caleb@calebdorris.com or call (615) 914-1073.

Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase. Checking the box on the quote form is optional, and the form can be sent with it unchecked. I don't send marketing or promotional texts unless you consent to them separately. The sentence on the form is:

Yes, text me about my quote request and project from Caleb Dorris. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help. Consent is not a condition of service. See the Privacy Policy and Terms.

The Privacy Policy explains how I handle your number and consent. Your mobile information and opt-in data are not shared with third parties for marketing.

Third-party services

Projects often connect to software I don't control, such as hosting, CRMs, payment processors and other APIs. I'm not responsible for their outages, price changes, policy changes or data handling, though I'll help you work around them as the scope allows.

Disclaimers

The website is provided as is. Except for any warranty written into a signed scope, my services and deliverables are provided as is, and I don't promise that software will be uninterrupted or error-free, or that marketing work will produce a particular ranking, traffic or sales result. To the extent Tennessee law allows, I disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent Tennessee law allows, I am not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from the website, a text message, or my services. My total liability for any claim is limited to the amount you paid me under the scope the claim relates to in the 12 months before the claim, or one hundred dollars if you haven't paid me anything. This limit doesn't apply where Tennessee law doesn't allow it.

Indemnity

You agree to indemnify me against claims, damages and reasonable attorney fees that come from your misuse of the site or the deliverables, from content, data or access you gave me without the right to share it, or from your business's use of the work in breach of law. This doesn't cover my own misconduct.

Governing law and disputes

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Before filing a claim, email caleb@calebdorris.com and give me 30 days to try to resolve it informally. If we can't, either of us may bring the claim in small claims court or in the state courts in Davidson County, Tennessee, and we both consent to venue there.

Changes to these terms

I may update these terms by posting a new version on this page and changing the effective date. Using the site after that date means you accept the new terms. A signed scope already in place keeps the terms it was signed under unless we agree otherwise in writing.

General

If a court finds part of these terms unenforceable, the rest stays in effect. Sections that by their nature should continue, including ownership, disclaimers, limitation of liability, indemnity and governing law, survive after you stop using the site or a project ends. These terms, the Privacy Policy and any signed scope are the whole agreement between us on these subjects.
